The short and simple answer to knowing if your trademark is already taken or not is “PUBLIC SEARCH REPORT”

The Trademark Registry in India has opened a public search facility through their trademark online Portal.

You may check if your brand name is already taken in two ways mentioned below:

Method1: Enquire at www.legalbrothers.in for free

Steps: Click on the link www.legalbrothers.in/trademark-registration-application/ and fill the form at the right most corner and click on the button arrange the call. Method2: Do a public search on the ipIndiaonline government portal

• Visit the link http://ipindiaonline.gov.in/tmrpublicsearch/
• Fill the Form as mentioned below:

• Enter the brand name in the column against
• Enter the class if you know in the column against
• Hit Search Button to know the result.

You will see a window like this:

For instance, Suppose, if I wanted to check my proposed Trademark “Women’s care” to know if it’s already taken or not within class 44. I followed the above mentioned steps to know the trademark status for somewhat similar worldmark, and it took me to a page shown above.

This page clearly represents that “Women’s care” is a refused trademark; which means “women’s care” was applied by some other party but had been refused later.

That clearly states that as of now my proposed brand name is not already taken by any other party. And hence, I can apply a trademark for my proposed names.
